1. Consent to Receive SMS Messages

By providing your mobile number, you consent to receive occasional text messages (SMS) from Najah Ayoub Foundation (NAF) regarding:

  • Charity events, poker tournaments, and fundraising initiatives

  • Updates about donation drives and community projects

  • Reminders and important announcements

You understand that:

  • Message frequency varies (typically less than 1 text per month).

  • Message and data rates may apply based on your mobile plan.

  • No purchase or donation is required to subscribe.

You can opt out at any time by replying STOP to any text message, or by emailing admin@najah.ca with the subject line “Unsubscribe from SMS.”

2. Privacy and Data Use

Your phone number and related contact details will be used solely for communications from NAF.
We do not sell, rent, or share your mobile number with third parties for marketing purposes.
We may use reputable third-party providers (e.g., Mailchimp) to send our messages, in compliance with their privacy and anti-spam policies.

3. Opt-In Confirmation

After you sign up, you may receive a confirmation message asking you to verify your consent.
To complete your subscription, you must reply or confirm as instructed.

If you change your phone number, please unsubscribe and re-subscribe with your new number.

  • To stop receiving texts, reply STOP at any time.

  • To get help, reply HELP or email admin@najah.ca.

  • After opting out, you may still receive administrative or event-related texts if required by law or for prior commitments (e.g. event registration reminders).

5. Your Rights

As a Canadian subscriber, your data is protected under the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Legislation (CASL).
You have the right to access, correct, or delete your information, or withdraw consent at any time.

Terms & Conditions Effective Date: Jan 1, 2025 1. Introduction These Terms & Conditions (“Terms”) govern your access to and use of the website najah.ca (the “Site”) and any services, content, or functions offered through the Site by the Najah Ayoub Foundation / NAF (“we”, “us”, “our”). By accessing, registering, donating, or using any features of the Site (including SMS campaigns via Mailchimp), you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site. 2. Our Mission & Nonprofit Status Najah Ayoub Foundation is a Canadian non-profit (charitable) organization, established in memory of “Sunshine,” with the mission of supporting charitable causes such as the Ottawa Hospital, cancer initiatives, educational support and community projects. 3. Use of the Site You may use the Site for lawful purposes only and in accordance with these Terms. You must not use the Site in any way that causes, or may cause, damage to the Site or impair its availability or accessibility. You must not use the Site for any unauthorized or unlawful purpose, including violating applicable laws or infringing on others’ rights. You may not attempt to gain unauthorized access to parts of the Site, or to other systems or networks connected to the Site. 4. Donations, Registration & Events When you donate, register for a tournament, or otherwise participate in an event, you agree that your details (name, contact information) may be used to process your transaction, issue tax receipts, and send communications (including SMS, if opted in). All funds raised are forwarded to the designated charitable recipients, as indicated on the Site (e.g. Ottawa Hospital, etc.). The Site may require that you provide truthful and accurate information when registering or donating. 5. SMS / Text Messaging & Communications By opting in to receive SMS / text messaging, you consent to receive periodic text messages from NAF (via our SMS provider, e.g. Mailchimp) regarding events, fundraising, updates, and campaigns. Message & data rates may apply per your mobile carrier. You may opt out of SMS messages at any time by replying “STOP” (or another instruction) or by contacting us directly. We will not send you more often than a reasonable frequency (you may define a maximum number). We reserve the right to suspend or cancel SMS communications to any number for noncompliance or abuse. 6. Intellectual Property All content on the Site (text, graphics, logos, images, audio, video) is owned or licensed by us unless otherwise noted. You may not copy, reproduce, republish, upload, post, transmit, or distribute in any way any of the content from the Site without our prior written permission (except that you may view, download, or print pages for your personal, noncommercial use). 7. Disclaimers & Limitation of Liability The Site is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee that the Site will be uninterrupted or error-free, or that defects will be corrected. In no event shall NAF (or its trustees, volunteers, agents) be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid (if any) to us in the last 12 months, or one hundred Canadian dollars (CAD $100), whichever is less. 8. Indemnification You agree to indemnify, defend, and hold harmless NAF (and its volunteers, employees, agents, trustees) from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Site or your violation of these Terms. 9. Changes to Terms We reserve the right, at our sole discretion, to update or modify these Terms at any time. We will post the updated Terms on the Site, with a new “Effective Date.” Your continued use of the Site after such changes constitutes your acceptance of the updated Terms. 10. Termination We may suspend or terminate your access to the Site (or parts thereof) at any time, without notice, for any reason (including breach of these Terms). Upon termination, all provisions of these Terms which by their nature should survive will survive (e.g., ownership, disclaimers, indemnification). 11. Governing Law & Dispute Resolution These Terms are governed by and construed in accordance with the laws of Ontario and Canada, without regard to conflict of law rules.
